Interpretation
Guarantor means a person who has [guarantee]d the performance by the mortgagor or lessee, as the case may be, or by any other person of any covenant, condition, or agreement expressed or implied in a mortgage or lease, whether the guarantee is expressed in the mortgage or lease or in any other instrument; and includes any person (not being the mortgagor or lessee, as hereinafter defined) who is liable under the provisions of the mortgage or lease, or against whom any person has a legal or equitable right of indemnity in respect of any liabilities under the mortgage or lease; and guarantee has a corresponding meaning
