Agreements for sale and purchase of land
In the application of this Act to an agreement for the sale and purchase of land the agreement shall be deemed to be a mortgage of the land to secure payment of the unpaid purchase-money and interest thereon and fulfilment of the conditions set forth in the agreement; the term [mortgagee] shall mean the vendor named in the agreement or, if the rights of the vendor have been assigned or have been transferred by operation of law or otherwise, the person for the time being entitled to those rights; and the term mortgagor shall mean the purchaser named in the agreement or, if the rights of the purchaser have been assigned or have been transferred by operation of law or otherwise, shall mean the person for the time being entitled to those rights. In any case where the rights of the purchaser have been assigned or transferred as aforesaid the original purchaser and any purchaser intermediate between him and the person for the time being entitled to the rights of the purchaser shall be included in the term guarantor as hereinbefore defined.
